Acceptable use

Every rule and clause is already in the terms and conditions of use. Where the two differ, the contract is the contract.

Applicability

The organisation and every person given an account. A company, whether knowingly or not, is responsible for what its own users do (clause 8.1.4).

Proper usage

Under clause 2.3 no material may be accessed, stored, distributed or transmitted through the service that:

  1. is unlawful, harmful, threatening, defamatory, obscene, harassing or racially offensive;
  2. facilitates illegal activity;
  3. depicts sexually explicit images;
  4. promotes unlawful violence;
  5. is discriminatory in any way; or
  6. is otherwise illegal, or causes damage or injury to any person or property.

The software should not be corrupted or exploited (clauses 2.3 and 2.4.6).

Regulations

  1. do not modify, duplicate, frame, mirror, republish, download, display, transmit or distribute any part of the software;
  2. do not decompile, disassemble, reverse engineer or reduce any part of the software to a form a person can read;
  3. do not use it to build a competing product or service;
  4. do not use it outside the agreed field of use;
  5. do not license, sell, rent, lease, transfer, assign, distribute or otherwise make it available to anyone else; and
  6. do not access it by any route other than via the licence.

Accounts

An account belongs to the person it was issued to and is not shared. The organisation is responsible for use of its accounts (clause 2.5).

The people in the conversation

The organisation owns content and is responsible for the legality, reliability, integrity, accuracy and quality of it (clause 4.1), and must wholly comply with the law (clause 8.1.2). Roles and responsibilities under UK GDPR are set out in data protection.

If this is breached

Access to any material that breaches clause 2.3 can be immediately disabled without liability. Performance can be suspended while a breach continues (clause 8.4.1). A material breach that is not remedied within 30 days ends the contract (clause 14).
